Court Upholds Sentence In Mortgage Fraud

An appeals court has upheld the one-year sentence of the former owner of Freedom Financial Mortgage Company in Little Rock.

The 8th U.S. Circuit Court of Appeals on Monday turned away a request by federal prosecutors to add time to Nelson Miller's sentence.

Miller was convicted in January 2008 of conspiracy to commit wire fraud and 15 counts of wire fraud.

The appeals court found that U.S. District Judge J. Leon Holmes calculated the sentence correctly. Miller argued that the intent of the fraud was to collect fees by selling loans, and didn't figure on anticipated foreclosure on some of the loans.

Miller was also fined $40,000.
